Update on the Public Service Pensions Redress

Please note that Phase Two of the process to give redress  to Public Services employees who suffered from discriminatory pension practices under apartheid. To be eligible employees musty have been in service on 2 September 1998. The closing date for applications are on 31 August 2010. Provincial task teams have been established in each province to deal with the process. Application forms must be obtained from your department and/or please contact the PSCBC for the contact details of the provincial task team members. The following catergories of people would be eligible. Please see the attached for more information,

EMPLOYEES DISCRIMINATED AGAINST ON BASIS OF RACE, GENDER OR STATUS OF EMPLOYMENT

  Waiting periods for former General Assistants (GAs) and Casual workers.

Admission to the following pension funds was subjected to waiting periods:

01.10.1979:   Temporary Employees Pension Fund (5 years – 2 years)

04.09.1992:   Temporary Employees Pension Fund (2 years)

24.01.1992:   Black Authorities Superannuation Fund (5 years – 2 years)

01.04.1967:   Non White Government Employees Pension Fund (5 years)

All other persons who had to complete qualifying/waiting periods of government service before admission to a pension fund,Female teachers and other female employees in the public service who lost pensionable service due to changes in marital status and admitted to the Temporary Employees Pension Fund (TEPF) on re-employment,

Female teachers and other female employees in the public service who had to resign to give birth and upon return were admitted to the TEPF,

All students such as nurses, radiographers, physiotherapists who were denied membership of a government pension fund based on status of employment, i.e. fixed term contracts.

All black students employed in a full time capacity who upon completion of studies were further subjected to waiting periods based on race.

South African citizens who were employed in the former Bophuthatswana before 1996.

RSA citizens who were employed in the former TBVC States.

Kits konstabels – the period served as Kits konstabel before permanent appointment to be recognized as pensionable service.

Employees admitted to temporary funds due to their medical/physical status, and

All former Municipal Police employees that were incorporated into the South African Police Service during 1989, and still belong to Municipal Pension Funds, in GEPF with effect from     1 June 2003.

2.2       STRIKERS

Employees of the former Transvaal Provincial Administration (TPA)  and certain Free State Hospitals dismissed for the 1987 strikes – Gauteng Health: Natalspruit, Sebokeng, JG Strijdom (Helen Joseph), Vereeniging (Kopanong) Hospitals and Free State,

Employees affected by the 1988 dismissals in the former Natal Provincial Administration (NPA),

South African Police (SAP) members dismissed in 1990, and

Employees dismissed for participating in strikes in the TPA between 1991 and 1993 (and later reinstated/re-employed with or without an agreement).
